A three-member panel, led by Justice Hamma Barka, delivered the judgment on Friday, dismissing two appeals filed by Senator Esther Nenadi Usman, the caretaker committee, and the Independent National Electoral Commission (INEC). Justice Barka confirmed that no court has overturned the November 2024 ruling, solidifying Abure’s position.
“The court has not addressed the issue of Labour Party leadership, as such matters are not justiciable,” Justice Barka stated during the ruling.
The court also declared actions taken without proper jurisdiction as null and void, striking out the October 8, 2024, judgment by Justice Emeka Nwite of the Federal High Court. Justice Barka ruled that the Federal High Court lacked jurisdiction to make such a decision, rendering it ineffective.
Reiterating its earlier judgment, the appellate court concluded, “Julius Abure remains National Chairman of the Labour Party.”
The leadership crisis began when a faction, backed by Senator Nenadi Usman and a caretaker committee, challenged Abure’s position, resulting in prolonged legal battles over control of the party.
