The Court of Appeal in Abuja has directed a fresh hearing in the legal tussle over the disputed Kano Emirate involving Alhaji Nasir Ado Bayero.

Delivering the lead judgment on Friday, Justice Mohammed Mustapha declared that Bayero was denied a fair hearing due to the flawed manner in which the Kano High Court conducted proceedings.

“The Kano High Court was unfair to the appellant by conducting proceedings without serving him a hearing notice, thereby denying him the opportunity to present his case,” Justice Mustapha stated.

The court emphasized the importance of ensuring justice for all parties by providing equal opportunities, describing the proceedings against Bayero as a “travesty of justice.” Justice Mustapha added, “All courts of law are bound to ensure justice for all parties by giving them equal opportunities.”

The appellate court further held that Bayero should have been served a hearing notice to present his grievances before the initial judgment was delivered.

As a result, the case has been remitted to the Chief Judge of the Kano State High Court for reassignment to another judge for an expedited hearing.

Justice Mustapha refrained from awarding costs against the respondents in Bayero’s appeal.
