The decision was delivered on May 21, 2025, by a three-member panel led by Justice Hamman Barka, after Akpabio’s legal team sought to withdraw the motions.
The motions, filed in March 2025, were part of an appeal challenging a ruling by the Federal High Court in a case involving Senator Akpoti-Uduaghan and other respondents. Akpabio had asked the appellate court to grant him additional time to file his appeal, leave to appeal the judgment, and an order to halt further proceedings.
Following his counsel’s application to withdraw the motions, the court approved the request and struck out both motions. It also imposed a N100,000 cost against Akpabio in favour of the first respondent, Senator Akpoti-Uduaghan.
The appeal is now set to be removed from the court’s records.
