The case was instituted by Alhaji Ibrahim Mohammed Aminu, a former Zazzau Emirate kingmaker, who contested the legitimacy of Emir Bamalli’s selection by former Kaduna State Governor, Mallam Nasir El-Rufai, in October 2020. Aminu alleged that due process was not followed in the appointment and initially sought redress at the Kaduna State High Court, but the case was struck out.
At the appellate level, the court ruled that the case was filed beyond the legally permitted timeframe, rejecting arguments that it should be treated as an exception. The judges affirmed that the case did not meet the required legal conditions for an extension, leading to its dismissal.
Reacting to the judgment, Wazirin Zazzau, Khadi Muhammad Inuwa, described the ruling as a victory for justice. Counsel to the appellant, Muhammed Tajudeen Muhammed, stated that he would review the judgment before advising his client on the next course of action.
