Delivering the judgment, Justice Nwosu-Iheme ruled that the prosecution team had successfully proved its case beyond reasonable doubt.
Nwachukwu was first arraigned on June 3, 2022, on a 23-count charge, which included allegations of culpable homicide, spousal battery, and criminal intimidation. During the trial, the prosecution called 17 witnesses among them Osinachi’s children and submitted 25 documents as evidence. The defense presented five witnesses, including Nwachukwu himself, and tendered four exhibits in his favor.
Before the sentencing, Nwachukwu’s lawyer appealed to the court for leniency. However, the prosecution urged the court to strictly enforce the law. Justice Nwosu-Iheme, after considering the arguments, sentenced Nwachukwu to death by hanging on the charge of culpable homicide. He was also handed prison terms ranging from six months to three years on other counts, alongside fines totaling N700,000.
